2.2 Contract Terms: Engaging our services requires signing a contract outlining the scope, payment terms, and obligations, similar to the Renovation Work Contract provided. Key terms include:

  • Contract Sum: Agreed fees subject to adjustments for variations or discarded scope.

  • Payment Terms: Staged payments with overdue payments accruing a percentage annual interest.

  • Completion: Timelines are mutually agreed, with extensions for delays beyond our control (e.g., force majeure, client delays).

  • Profit of Attendance: A percentage fee (plus miscellaneous charges) applies if third-party contractors are engaged.

  • Payment methods: Bank Transfer, FPX, or other approved channels.

2.3 Variations: Changes to the scope require written approval and may incur additional costs.

2.4 Intellectual Property: All designs and drawings remain our property, with clients granted a non-exclusive license upon full payment.

3. Limitation of Liability

3.1 We are not liable for damages arising from:

  • Third-party contractor work or client-provided designs.

  • Delays or issues due to client actions, site conditions, or external factors.

  • Website inaccuracies or interruptions, unless caused by our gross negligence.

 

3.2 Our liability is capped at the contract sum paid for the services.

4. Governing Law

4.1 These Terms and Conditions are governed by the Laws of Malaysia, with disputes resolved via negotiation or arbitration under the Arbitration Act 2005.
